ARTICLE 1: DEFINITIONS
At GymOne, we believe it is very important to make clear and transparent agreements with our members. That way we keep it fun for everyone. By becoming a GymOne member, you declare to have read and accepted the general conditions and house rules. You can find the general conditions and house rules at www.gymone.nl.
1.1 Promotion: the offer offered by GymOne to new members. Contract duration and price differ from GymOne's standard prices.
1.2 Storno Charges: an amount charged in the event of an unsuccessful collection.
1.3 Contribution/membership fee: the amount of membership you have to pay every 4 weeks.
1.4 Member: you can become a member with us if you are a person 12 years and older.Â
1.5 Financial Officer: the person who is financially responsible for membership fees.
1.6 Upgrade: a conversion of a membership in which the value of the membership is increased.
1.7 Registration fee: cost for activation of a membership. This applies per person.
1.8 Membership: the agreement that is entered into between you and GymOne by becoming a member through registration. These terms and conditions also belong to your membership.
1.9 Day pass: a €8 admission ticket valid for 1 day.
1.10 Locker: locker where you can store your belongings.
1.11 Notice period: 1 full collection period which GymOne will collect from you when you cancel your membership.
1.12 Main payer: member who is responsible for payment in the case of a Duo membership. The membership fee is deducted from the main payer's account number.
1.13 Collection Period: a full 4-week collection period.
1.14 Personal guidance: supervision of members by Gym Staff, explanation of the equipment or fitness tips.
1.15 Off-peak hours: the off-peak hours subscription allows you to check in from 07:00 to 17:00 on weekdays and from 08:30 to 17:00 on weekends.
1.16 Rato: the amount calculated back to a day pass.  Â
ARTICLE 2: NOTIFICATION
2.1 You can become a GymOne member through the registration form on the GymOne website or at the facility itself.
2.2 Becoming a member through a Sports Fund should go through the front desk at one of the GymOne locations.
2.3 After registration, you can join GymOne immediately and have access to all GymOne locations.
2.4 On your first visit, a photograph will be taken of you.
ARTICLE 3: ACCESS AND PERSONAL DATA
3.1 When you become a member, your personal data is registered in our records.
3.2 By becoming a GymOne member, you authorize GymOne to collect membership fees by direct debit.Â
3.3 Your access to GymOne is controlled by scanning the QR code at the entrance. You are required to always scan in at the front desk when you enter.Â
3.4 With a Duo membership, you may always come to exercise at the same time.
3.5 Your personal data is strictly confidential and will not be used for any purpose other than to grant you access to GymOne.
3.6 Your personal data will never be provided to third parties.
3.7 GymOne has permission to use your personal data for communications.
3.8 When you check in to exercise, a picture of you is displayed on the checkout screen for verification purposes. GymOne cannot prevent this photo, intended for the Gym Employee, from being visible to other members/third parties.
ARTICLE 4: MEMBERSHIP, TERM AND PAYMENT
4.1 Your membership officially starts from the moment you become a member for an indefinite or definite period (depending on your chosen membership), with a minimum of 2 full collection periods.
4.2 If you have opted for an Unlimited, off-peak hours or Duo membership, these will automatically be extended for an indefinite period of time after your contract term has expired. Your membership can be cancelled 4 weeks later and you have a notice period of 1 full payment period after unsubscription.
4.3 If you have chosen a Flex membership you have a notice period of 1 full collection period after unsubscribing. Please note that there is a minimum of 2 collection periods.Â
4.4 Up to the age of 18, you need permission from a parent/guardian to become a member at GymOne. This can be done through the consent form in the registration form on the website or at the facility itself.
4.5 When you use a Duo membership, you must both be able to prove that you live at the same address.
4.6 Payment for your membership is made 4-weekly.
4.7 You should ensure that we can collect the membership fee without any problems. If this fails, we will be forced to charge you €5,00 for each failed collection.
4.8 If you have not paid your dues on time, you are automatically in default. We determine for each incident at which time the default will be rescinded.
4.9 In the event of payment arrears with an Unlimited, Daluren, or Duo membership, 100% of the full remaining amount as a total claim is due at once. Subsequent extrajudicial collection costs will be at your expense and amount to 15% of the amount due, with a minimum of €40.00.
4.10 If you have not paid your dues on time, access to GymOne is not possible.Â
ARTICLE 5: RATES, CONTINUED MEMBERSHIP, ACTIONS, GENERAL CONDITIONS
5.1 We reserve the right to modify or supplement our terms and conditions and house rules.
5.2 We reserve the right to index and/or change our prices and rates of memberships and supplements according to CBS statistics.
5.3 Price adjustments due to government measures may be implemented immediately regardless of the amount and do not give the right to terminate the contract.Â
5.4 We may increase our rates once a year, on January 1, according to CBS statistics. If we make use of this, it does not give you the right to terminate the agreement, unless the rate increase occurs within 3 months of the conclusion of the membership.
5.5 For promotions and/or special offers, you can check the conditions in the GymOne branches or through our customer service.
5.6 No prior or subsequent rights can be derived from promotions and/or special offers.
5.7 Action periods are always applied prior to membership unless we specify otherwise. Action periods are outside the contract period.
5.8 Actions taking place at a new branch are only valid if you become a member at this new branch.
5.9 Under no circumstances can you claim a refund of dues or other amounts.
5.10 Being absent for any reason does not relieve you of the obligation to pay the dues due and does not entitle you to any reduction thereof.
ARTICLE 6: CONVERSION/CANCELLATION
6.1 If you wish to make a conversion, this is only possible at the time your 1 or 2 year membership expires unless you wish to upgrade your membership which increases the value of the membership.
6.2 When upgrading and/or converting your membership, the start date will take effect at the next collection period. From that moment on, your new membership term starts.
6.3 If you want to cancel your membership, you can do so via the GymOne app, by mail or by email klantenservice@gymone.nl.Â
6.4 Interim cancellation/freezing of a membership is only possible if:
- You change your residential address further than 20 kilometers (based on the shortest route) from one of the GymOne locations. This is only accepted if you have an official document "registration municipality" of the new residence as proof. If this document is approved by us, you will need to purchase your membership. In case of a 1 or 2 year membership, your membership fee will be recalculated to a Flex membership.
- When you can no longer use your membership due to injury or illness. The membership can then be stopped for a maximum of 3 full collection periods, your membership is then stopped. When you stop your membership for 3 full collection periods it will continue for 3 full collection periods longer. This can only be accepted with a provable document as proof.
- When the government decides that there will be a mandatory closure period. When this is the case we give you the option to temporarily freeze your membership while the measure is in effect. Once this mandatory closure period is lifted your membership will automatically resume.Â
6.5 When you unsubscribe yourself as the main payer of your Duo membership, the entire membership is automatically terminated for the other linked members.
6.6 When you have entered into a membership via the online registration form
of the GymOne website you have a withdrawal period of 14 days. This withdrawal period starts on the day you have concluded your membership.
6.7 If you decide to revoke your membership you must do so by completing the revocation form on the website.Â
6.8 If you want to revoke your membership and you do not use it during these 14 days, the revocation is free of charge. If you have used the membership during this period, GymOne can charge you pro rata (from the activation of your membership to the day of revocation, excluding the registration fee).
6.9 Unsubscriptions by online chat, social media, telephone or verbally, will not be processed.
6.10 If you do not comply with the terms of the agreement, our house rules or display inappropriate behavior at the direction of GymOne employees, we may deny you access to GymOne and terminate your membership immediately. The assessment of this behavior is the sole responsibility of GymOne. If you become a GymOne member again, this gives you good reason to terminate your membership again.
6.11 Any credits cannot be used after the termination of
the membership.
ARTICLE 7: RISK AND LIABILITY
7.1 Use of GymOne's facilities is entirely at your own risk.
7.2 If you are the main payer of a Duo membership, you are responsible for the membership at all times. In case of overdue payments, all linked (family) members will be held liable.
7.3 We are not liable for material or immaterial damages resulting
from accident or injury you sustain in our Gyms.
7.4 We advise you not to bring valuables with you. However, GymOne does offer
lockers to minimize damage, loss or theft of belongings. The cost of a GymOne combination locker is a one-time fee of €8.00. The use of your own locker is not permitted.
7.5 We are authorized to cut open remaining locks after closing so that the lockers will be usable again the next day.
7.6 Fitness can involve risks. When using our facilities you are responsible for knowing what you can handle. Using the facilities is your own risk. If in doubt about your physical condition, we recommend that you seek expert advice from a doctor or specialist to determine what is the right and feasible way for you to exercise.
7.7 We do not offer personal training by our own Gym Staff at the facility. However, we do offer free coaching to help you reach and/or achieve your goals. You can hire a Personal Trainer yourself or use the tips and advice we provide on social media, the GymOne app or through other means in the gym. However, we are not responsible for how you apply these tips and advice and the choices you make.
7.8 Only persons 18 years of age or older may use the tanning bed.Â
7.9 We are not liable for damage to and/or theft of your vehicle
or other means of transportation as a result of parking on GymOne's premises.
7.10 You are liable for damage caused to our property if
such damage is due to negligence and/or fault on your part.
7.11 It is not permitted to make and publish sound and/or visual recordings of staff or members without permission.
ARTICLE 8: COMPLAINT HANDLING
8.1 If you have any complaints we are very sorry, but of course we are happy to hear about them
. You can always contact our customer service via the GymOne website. We ask you to mention your name and address and a description of the complaint. We will then take care of your complaint.
ARTICLE 9: CONCLUSION
9.1 By becoming a member you declare to know, accept and act upon the terms and conditions and house rules.
9.2 GymOne's general conditions and house rules can be found on the website
and you can ask for them at the GymOne front desk.
